3. Free Resources, Checklists, and Audits

Any free checklist, guide, audit, review, worksheet, or similar resource provided through this website is for general informational and educational purposes only.

 

These resources are designed to help identify potential marketing, funnel, follow-up, or conversion issues. They are not a guarantee of results and should not be treated as legal, financial, medical, or professional compliance advice.

 

4. No Guaranteed Results

Marketing performance depends on many factors, including the offer, market, budget, competition, targeting, creative, follow-up, sales process, platform behavior, client responsiveness, and external conditions.

Daniil Pleshkov Marketing applies strong marketing principles, current best practices, hands-on experience, platform knowledge, and ongoing learning to deliver high-quality work. The goal is always to provide thoughtful, strategic, and effective marketing support.

However, no specific outcome is guaranteed. This includes, but is not limited to, leads, bookings, sales, revenue, profit, return on ad spend, lower cost per lead, ad approvals, platform performance, or business growth.

 

5. Client Responsibilities

Clients are responsible for providing timely access, information, approvals, feedback, and materials needed to complete the agreed work.

This may include access to advertising accounts, websites, CRM systems, analytics, tracking tools, payment processors, email platforms, calendars, creative assets, offers, pricing, claims, customer information, and other business systems.

Client delays may delay project timelines, launches, reporting, optimization, or results.

Clients are also responsible for ensuring that their own business claims, offers, pricing, testimonials, medical claims, legal claims, financial claims, regulatory statements, and compliance requirements are accurate and lawful. Daniil Pleshkov Marketing will make reasonable efforts to review work carefully and flag obvious concerns where possible, but final responsibility for business accuracy and compliance remains with the client.

 

6. Payments

Unless otherwise agreed in writing, payment is required upfront before work begins.

For ongoing retainers, payment must be made according to the agreed billing schedule. If payment is late, Daniil Pleshkov Marketing may pause work, pause services, delay deliverables, or withhold access to work until payment is received.

Fees are generally non-refundable once work has begun, time has been reserved, strategy has been developed, or deliverables have been started.

That said, client satisfaction matters. If something is not up to the agreed standard, Daniil Pleshkov Marketing will make reasonable efforts to fix, revise, or address the issue in good faith.

 

7. Cancellations and Offboarding

For ongoing monthly retainers, clients are required to provide 60 days’ written notice before cancelling, unless otherwise agreed in writing.

During the notice period, Daniil Pleshkov Marketing will work through a clean offboarding process, which may include transition notes, access cleanup, documentation, handoff materials, and reasonable support to help the client transition smoothly.

Daniil Pleshkov Marketing may request a review, testimonial, or feedback from the client as part of the offboarding process, but the client is not required to provide one unless agreed separately.

 

8. Revisions and Approvals

Unless otherwise agreed in writing, deliverables include up to two rounds of reasonable revisions.

Once a deliverable is approved, it is considered final. Additional changes, revisions, rebuilds, strategy shifts, or new requests after approval may be billed separately.

Approval may be given in writing by email, message, project management system, call confirmation, or any other agreed communication method.

 

9. Scope of Work

Work outside the agreed scope may require additional payment and written approval before proceeding.

Examples of out-of-scope work may include additional pages, new funnels, extra automation logic, new campaigns, additional creative requests, major revisions, new integrations, emergency requests, or changes caused by inaccurate or incomplete client-provided information.

 

10. Communication and Availability

Primary communication is by email, with calls scheduled as needed.

Unless otherwise agreed, work and communication take place during regular weekday business hours. Daniil Pleshkov Marketing does not guarantee weekend, holiday, after-hours, or emergency availability.

Response times may vary depending on workload, project stage, and the nature of the request.

 

11. Advertising Accounts and Ad Spend

Clients are responsible for paying their own advertising spend directly to platforms such as Meta, Google, LinkedIn, TikTok, or any other advertising platform, unless otherwise agreed in writing.

Daniil Pleshkov Marketing is not responsible for platform decisions, including ad disapprovals, account restrictions, account bans, tracking issues, algorithm changes, policy changes, billing issues, outages, or performance fluctuations.

Daniil Pleshkov Marketing will use reasonable care, experience, platform knowledge, and best practices to set up and manage campaigns properly, follow applicable platform guidelines, and reduce avoidable risk.

 

12. Third-Party Platforms and Tools

Services may rely on third-party tools and platforms such as Meta, Google, GoHighLevel, Shopify, WordPress, Stripe, Zapier, Make, Typeform, email/SMS providers, analytics tools, CRM platforms, hosting providers, or other software.

Daniil Pleshkov Marketing is not responsible for downtime, errors, bugs, outages, policy changes, pricing changes, data loss, integration failures, or service interruptions caused by third-party platforms.

 

13. Intellectual Property

Unless otherwise agreed in writing, once the client has paid all amounts owed, the client owns the final approved deliverables created specifically for them.

However, Daniil Pleshkov Marketing retains ownership of pre-existing materials, templates, frameworks, processes, methods, strategies, systems, checklists, SOPs, internal tools, training materials, know-how, and general marketing approaches used to produce the work.

Clients may not copy, resell, distribute, or reuse Daniil Pleshkov Marketing’s internal templates, frameworks, or proprietary methods outside the agreed engagement without written permission.

 

14. Portfolio, Case Studies, and Results

Daniil Pleshkov Marketing may use anonymized or generalized client work, outcomes, screenshots, results, learnings, or case studies for marketing, educational, or portfolio purposes, unless the client requests otherwise in writing.

Any public case study that identifies the client by name, brand, or clearly recognizable details will require permission.

 

15. Confidentiality

Daniil Pleshkov Marketing will take reasonable care to keep client information confidential.

Confidential information may include business strategy, customer data, lead data, sales information, pricing, internal systems, advertising accounts, analytics, CRM data, and other non-public information shared during the engagement.

Confidentiality does not apply to information that is public, already known, independently developed, lawfully received from another source, or required to be disclosed by law.

 

16. Data and Privacy

Daniil Pleshkov Marketing may handle information such as names, emails, phone numbers, lead details, CRM records, website data, analytics, and other client or customer information while providing services.

This information will be handled with reasonable care and used only for the purpose of providing the agreed services.

Use of this website may also be subject to a separate Privacy Policy, especially where forms, tracking pixels, cookies, analytics, email opt-ins, or advertising tools are used.

 

17. Limitation of Liability

To the fullest extent permitted by law, Daniil Pleshkov Marketing will not be liable for indirect, incidental, special, consequential, punitive, or business-related damages, including lost profits, lost revenue, lost leads, lost sales, business interruption, loss of data, advertising account issues, platform restrictions, or missed opportunities.

Where liability cannot be excluded, total liability will be limited to the amount paid by the client to Daniil Pleshkov Marketing for the specific service giving rise to the claim during the most recent 60 days.

 

18. No Professional Legal, Medical, or Financial Advice

Daniil Pleshkov Marketing provides marketing and business growth services. Nothing on this website or within any service should be treated as legal, medical, financial, tax, accounting, or regulatory advice.

Clients should consult appropriate professionals for those matters.

 

19. Website Use

You agree not to misuse this website, attempt to interfere with its operation, copy protected content without permission, submit false information, or use the website for unlawful purposes.

20. Governing Law
